SB 23-290 Natural Medicine Regulation and Legalization (Safety Clause)

The bill establishes the regulatory framework for the production and dispensation of natural medicine and natural medicine product and amends the Natural Medicine Health Act enacted into law by Colorado voters pursuant to Proposition 122.

  • The bill provides the Department of Regulatory Agencies director of the division of professions and occupations authority to:
    • Establish licensing procedures and requirements for facilitators who provide natural medicine services to participants;
    • Promulgate rules necessary for the regulation of facilitators and the practice of facilitation (performance and supervision of natural medicine services); and
    • Perform duties necessary to regulate facilitators, including investigatory and disciplinary authority.
  • The bill modifies the natural medicine advisory board (board) established in Proposition 122. The board will make recommendations to the director of the division of professions and occupations and the state licensing authority, which is the executive director of the department of revenue.
  • The bill creates the federally recognized American tribes and Indigenous community working group to establish a dialogue and identify issues arising from the commercialization of natural medicine, which will be facilitated by the division of professions and occupations.
  • The bill creates, within the department of revenue, the division of natural medicine to regulate and license the cultivation, manufacturing, testing, storage, distribution, transport, transfer, and dispensation of natural medicine or natural medicine product between natural medicine licensees. The bill requires the division of natural medicine to:
    • License and regulate natural medicine, natural medicine product, and natural medicine businesses, including healing centers, cultivators, manufacturers, and testing facilities;
    • Establish licensing procedures and requirements for natural medicine businesses;
    • Promulgate rules necessary for the regulation of natural medicine, natural medicine product, and natural medicine businesses; and
    • Perform duties necessary for the regulation of natural medicine, natural medicine products, and natural medicine businesses, including investigatory and disciplinary authority.

Effective Date: July 1, 2023
